Court acquits Marcola and family of money laundering charges

The defendant and his wife, Cynthia Giglioli Herbas Camacho, were accused of concealing the origin of R$479,756.37, transferred in 243 cash deposits, from January 2016 to August 2017, in the current account of a beauty salon whose monthly revenue was R$16 thousand.

According to Gaeco (Special Action and Combating Organized Crime Group), subordinate to the MP-SP, on June 12, 2018, Marcola’s in-laws purchased a luxury house in the Alphaville Granja Viana condominium, for R$ 1.1 million.

Gaeco’s investigations showed that three years earlier, in 2015, the same property, where there was an unfinished building, was valued at R$3 million — now it exceeds R$5 million. For Gaeco, the house was purchased at a price well below its value and there was money laundering.

Two other defendants in the same case were accused by the MP-SP and the Deic (State Department of Criminal Investigations) of selling the property to the prisoner’s relatives. The MP-SP had asked for everyone’s conviction and must appeal the court decision.

The acquittal was announced yesterday (24) by judge Leonardo Valente Barreiros. According to the magistrate, the accusation against the couple in relation to the beauty salon “does not prosper because it was not proven that the amounts in cash deposited in Cynthia’s account came from illicit activities carried out by Marcola”.

The judge also understood that “the conduct of hiding assets cannot be applied because the defendants registered purchase and sale contracts in their own names for the property where Cynthia, her parents and her sister live.”
