Lava Jato judge has 15 days to provide explanations to the CNJ and could be removed again

247 – The national inspector of justice, Luis Felipe Salomão, granted a period of 15 days for Danilo Pereira Júnior, current judge of the 13th Federal Court of Curitiba, where Operation Lava Jato cases are being processed, to present additional clarifications to the National Council of Justice (CNJ) , reports Lauro Jardim, from the newspaper O Globo.

Last week, Pereira Júnior was removed from his position by decision of Salomão, but was reappointed by the board. He is currently the target of a new order that could remove him from his duties. The inspector will analyze the case as soon as Pereira Júnior and his office present their defense in relation to the new accusations.

A disciplinary complaint, filed last week by lawyer Rodrigo Tacla Duran states that Pereira Júnior was committing new irregularities in the conduct of processes involving him. At the Federal Regional Court of the 4th Region (TRF-4), the judge participated, last year, in a trial that reinstated Tacla Duran’s arrest, going against decisions of the Federal Supreme Court (STF). Judges Loraci Flores and Carlos Eduardo Thompson remain away for this reason, but Pereira Júnior was spared as he was a substitute.

According to Tacla Duran, Pereira Júnior made decisions in the 13th Federal Court in an action to which he is a party on April 10, which would constitute duplicity prohibited by the Penal Code. The judge, after analyzing the case in the second instance, could not do so in the first instance either.

Tacla Duran also alleges that Pereira Júnior would not have sent the entirety of these records to the STF, as the Court determined a year ago. According to the complaint, there is a section missing.

According to Salomão, “the facts narrated deserve attention from the CNJ”, since they refer to “a supposed violation of the Statute of the National Judiciary”. He awaits the judge’s position to make a decision.
