The PL (Bill) that provided for the requirement of toxicological examination for new hires in the State of Santa Catarina was rejected in a vote by the CCJ (Constitution and Justice Commission) of Alesc (SC Legislative Assembly) this Tuesday (23) unanimously.

The project, authored by state deputy Jessé Lopes (PL), received six votes in favor of the inadmissibility report made by deputy Volnei Weber (MDB):

  • Napoleon Bernardes (PSD)
  • Sérgio Guimarães (União Brasil)
  • Tiago Zilli (MDB)
  • Volnei Weber (MDB)

The members of the commission did not participate in the vote: Pepê Collaço (PP), Ana Campagnolo (PL) and Camilo Martins (Podemos), president of the CCJ.

The rapporteur understood that the PL “does not deserve to prosper”, since “the state rule invades the Union’s private sphere of competence when regulating aspects related to labor law”.

In the document, Weber argues that the approval of the PL could violate the “principle of separation and harmony between the Powers”.

Congressman Jessé Lopes’ project provided for mandatory toxicological examinations to be carried out when hiring staff in Santa Catarina.

The deputy’s justification, according to the text, is due to “the broad freedom of contracting, permitted in article 168 and its paragraphs”.

According to the justification of the project, the law is considered restricted “by interpretation”, and may imply that companies cannot request toxicological tests to hire new employees.
