MPAC investigates use of public equipment on private properties in Capixaba

As a result of this suspicion, the Capixaba Public Prosecutor’s Office issued a Recommendation to the Municipality, through a letter sent to Mayor Manoel Maia Beserra, regarding the need to comply with legal standards pertaining to the use of public goods or services.

In the document, signed by prosecutor Vanderlei Batista Cerqueira, the supervisory body recommends that the Municipality refrain from carrying out any services on private properties, except those arising from social programs aimed at low-income people, duly registered.

The promoter also emphasizes that any donations of materials for the recovery of branch lines must be made without compensation or exchange that could give rise to a conflict of interest.

The Recommendation also invites the Municipality to adopt measures that facilitate supervision by municipal management, the population and the Public Prosecutor’s Office, including publication on the Transparency Portal and sending to MPAC, within 10 days, information relating to vehicles and machines belonging to the Municipality or in a contractual relationship, specifying in these cases the time of availability for use.

Finally, the prosecutor highlights that failure to comply with the Recommendation will result in the immediate adoption of appropriate judicial and extrajudicial measures by MPAC. He also emphasizes that the willful omission in adopting the measures may lead to the filing of a public civil action for administrative improbity.
