Fachin maintains R$30,000 fine for Nikolas for fake news against Lula

Carla Zambelli (PL-SP) also had her appeal denied. Zambelli had been convicted by the TSE for spreading fake news about electronic voting machines on social media. Like her party colleague, the federal deputy was also fined R$30,000.

It is not about protecting the interests of a state, organization or individuals, but rather about safeguarding the founding pact of Brazilian society: democracy through free, truly free elections. This is not a judgment of convenience in moral or political criteria, but rather the duty to act to prevent the existential annihilation of truth and facts.

Remember the case

Nikolas accused Lula of embezzling R$242.2 billion from public health. “That’s exactly what you heard. What would you do with that money? How many people would you help? That’s right. That was the amount that the PT diverted from Brazilian health in just their first three governments,” said the deputy in a video published on October 25, 2022 on social media.

Lula’s coalition called the TSE to remove the video from the air. At the time, the president of the TSE, minister Alexandre de Moraes, understood that Nikolas used decontextualized journalistic articles to try to give an air of truth to false information. He ordered the removal of the material and set the fine at R$30,000 — a decision later discussed in plenary and maintained by 6 votes to 1.
