Young Danielly Nakawasa Fernandes, 22 years old, has been hospitalized at the Mato Grosso Cancer Hospital (Hcan), in Cuiabá, since she was diagnosed with acute lymphoblastic leukemia. According to the Public Defender’s Office of Mato Grosso (DPMT), the amount of R$ 1.128 million was requested to be blocked in the accounts of the Government of Mato Grosso to purchase enough medication for Danielly’s first cycle of treatment, but it was denied by the courts.

According to the decision, the State Department of Health (SES-MT) establishes some requirements to provide the medicine, such as: medical report of the ineffectiveness of the medicines made available by the SUS, patient’s financial difficulties It is registration of the medicine with the National Health Surveillance Agency (Anvisa).

The Defender’s Office reported that, according to the petition filed with the Court of Justice (TJMT), the medicines offered by SUS are not effective for the treatment of disease and the only alternative to guarantee Danielly’s survival is the medicine ordered by the doctor.

SES-MT said that the drug will not be releasedas the necessary amount jeopardizes other scheduled health system procedures.

In December last year, judge Raul Leite determined that the municipality and the state should provide the medicine, in ten days. However, after challenges presented by the government, the decision was revoked by the Court on March 20th.

The Public Defender’s Office reported that it made a new urgent request for the patient to obtain the medicine, but has not yet received a response.

“Despite the high cost of the requested medicine in relation to the responsibility in the management of public resources, the right to be considered in the case in question is that of the dignity of the human person corroborated by the right to life of the patient, now appellant, which is his life is at risk,” said public defender Daniel de Souza Pinto.
