The minister of the STF (Supreme Federal Court) Alexandre de Moraes ordered the provisional release of the colonels of the PMDF (Military Police of the Federal District) Fábio Augusto Vieira, Klepter Rosa and Marcelo Casimiro, defendants for the undemocratic acts of the 8th of January, in Brasília. They had been arrested since August 18, 2023 on suspicion of failure to act on the day of the extremist actions.

The decision provides for compliance with precautionary measures such as the use of electronic ankle bracelets, the prohibition of being absent from the Federal District and home confinement at night and on weekends. Moraes also ordered a ban on leaving the country and the suspension of police officers carrying firearms, in addition to prohibiting communication with others involved in the acts.

In February, the PMDF (Military Police of the Federal District) transferred Vieira and Rosa to the paid reserve. Since then, they have received around R$18,000 per month. The ordinance that grants the benefit says that the police officers were transferred due to their length of service.

Defenses

“Each of the colonels who were present on the fateful day 8/1 had independent conduct. From the beginning, Colonel Klepter’s defense has drawn attention to this peculiarity, so that with the individualization of conduct and, consequently, responsibilities, the granting of provisional freedom would be the logical consequence”, says Klepter Rosa’s defense.

“The wise decision handed down today demonstrates that the work of the defense was effective, and reinforces our conviction that we will have a careful analysis, case by case, of each person’s conduct, and, in the end, the conviction of the learned ministers will certainly be for acquittal of Colonel Klepter”, say lawyers Newton Rubens and Almiro Júnior.

The defenses of Fábio Augusto Vieira and Marcelo Casimiro were not located by the report.

Remember the prisons

The then general commander of the PMDF, Colonel Klepter Rosa, and four other officers were arrested on the morning of August 18, 2023 in a joint action by the Federal Police and the PGR (Attorney General’s Office).

According to the PGR, the PMDF leadership failed to act to prevent extremist acts against the headquarters of the Three Powers due to ideological alignment with the criminals who attacked the Democratic Rule of Law.

According to investigations, police officers exchanged messages and disseminated false information with a coup content before the second round of the 2022 presidential elections.

In a statement, the PGR reported that it was found that there was a “deep ideological contamination on the part of the DF Military Police officers, who showed support for conspiracy theories about electoral fraud and coup theories.”

According to the agency, there is also mention of evidence that the police officers — who held command positions in the corporation — received, before January 8th, various intelligence information that suggested the movement’s “coup intentions” and the “imminent risk of effective invasion of the headquarters of the Three Powers”.
