The main bet is that Lula will partially veto the measure. As with other important vetoes, the PT member must leave the decision to the last minute, after listening to various sides and allies — which should occur in the middle of next week.

Recurring strategy

The partial veto has been a recurring government strategy. The alternative is seen as a way to please “both sides”, in addition to ensuring that the vetoed items are analyzed one by one by the Legislature. The total veto does not have this characteristic and can be overturned in just one vote.

Ministry of Justice recommended partial veto. Former member of the STF and jurist, Ricardo Lewandowski told Lula that he considers the text unconstitutional, since prisoners have the right to family life, as long as they meet the prerequisites, and that it would end up overturned in the Supreme Court.

Current Minister of Justice, Ricardo Lewandowski has a history against the incarceration policy. He implemented custody hearings within 24 hours of arrest, when he was president of the CNJ (National Council of Justice).

Defenders of the veto say that PL only makes the problem worse. They say that the approved text is not efficient and is a way of “covering the sun with a sieve”, as the data does not point to an increase in crime during the temporary departures. This would only hinder the process of resocialization of inmates and create even more problems in prisons. Along these lines were the guidelines of ministers Silvio Almeida (Human Rights) and Anielle Franco (Racial Equality), as well as a large part of the PT wing, which was always against the project.
