At the time, the electronic auction provided for the Price Registry for the acquisition of textbooks kits called “aprova brasil” and “territorio da Leitura” projects, whose value was estimated at R$ 9,203,881.81.
According to the TCE, Cautelar (n° 22100868-8) was based on a request made by the Audit Management of Bidding Procedures which pointed out, among other irregularities, the inadequate specification of teaching material, using the criterion of contracting by lot , instead of items, thus restricting the competition’s broad competitiveness and economy.
Other irregularities pointed out were the absence of extensive market research, limited to quotations with potential suppliers and not including amounts contracted by other public entities available on widely accessible government procurement portals, in addition to indications of targeting the object in favor of textbook kits from a specific publisher, with no proof of infeasibility of choosing a similar product from other publishers.
Cautelar also highlighted the lack of justification for defining the amount of 7,940 books intended for teachers and coordinators, when the correct amount would be 295, revealing evidence of potential damage to the Treasury of R$ 559,614.00.
“We emphasize that due to the proximity of the end of the 2022 academic year, most likely, the acquisition of the aforementioned bibliographic collection is intended for the planning of classes for the 2023 financial year, with reasonable time for the start of a new event with the corrections of the proposed public notice in the present inspection”, highlights the vote.
For these reasons, director Marcos Loreto issued the Precautionary Measure, unanimously endorsed in the First Chamber, with the votes of director Carlos Porto and substitute director Ricardo Rios (replacing director Valdecir Pascoal).
The rapporteur also determined the formalization of a Special Audit Process to examine the merits of the irregularities pointed out, and other issues that he deems appropriate, regarding the Electronic Auction, and that the management refrain from publishing a new Notice with the same object and without correcting the flaws. pointed here.
