Young Marcus Vinicius Machado Rocha, 22, who was in the Porsche involved in the accident that killed an app driver, was hospitalized again due to complications. He was at home, after having his spleen removed and being in an induced coma due to what happened. Now, he is under observation in a hospital in the capital of São Paulo.

To the Earthhis lawyer, José Roberto Soares Lourenço, stated that his client has been hospitalized since April 28th, because of a piece of his spleen that remained inside him after the surgical procedure.

“In other words, a complication. Doctors recommended that he remain under observation to assess whether he will need further surgery”, he explains.

Furthermore, Marcus Vinicius started to feel pain in one of his knees, indicating a problem with his tendons.

“Everything indicates that it is related to the accident, and that he will probably have to undergo a procedure”, he explains.

This is the second time that the young man has been hospitalized after the accident caused by his friend, Fernando Sastre de Andrade Filho, on Avenida Salim Farah Maluf, in São Paulo. On that occasion, the driver of the Porsche crashed into the back of the Renault Sandero, which was driven by app driver Ornaldo da Silva Viana, 52 years old. He could not resist the wounds and died.

Marcus was seriously injured, had several fractures, lost his spleen and was in an induced coma for a few days at the São Luiz Anália Franco hospital, in the capital of São Paulo. When he was minimally recovered, still in the health unit, he gave a statement to the police. At the time, he denied the version given by Sastre’s girlfriend, and said that his friend had been drinking before driving and that he was “altered”.

Businessman Fernando Sastre Filho is considered a fugitive by the courts. He had his preventive detention ordered last Friday, the 3rd, and on Saturday, the 4th, police officers went to his house, but did not find him.

According to information from the Public Security Secretariat (SSP), agents from the 30th Police Station carried out investigations at the businessman’s apartment, in Vila Regente Feijó, in São Paulo, to comply with the arrest warrant issued by the Court.

“After searching the residence, the suspect was not located. The efforts continue to seek his location and capture”, adds the ministry, in a note.

Preventive detention

The order of preventive detention followed an appeal from the Public Ministry of São Paulo (MPSP). Previously, three arrest requests against him had been denied in the first instance.

Judge João Augusto Garcia is the one who signs the decision. According to him, preventive detention aims to “protect public order, given the risk of reiterating conduct, and guarantee regular criminal investigation.”

In his decision, the judge also cited the other accidents in which Andrade Filho was involved and the record of his participation in a race on Avenida Paulista.

“In effect, the connection with similar acts, in the presence of indications that, even when urged by people not to drive, due to their condition (also indicated by the gas station attendant Reinaldo, who saw the defendant staggering away), make one believe in the possibility of reiterating non-compliance of norms, and the judiciary must be attentive to the protection of public order, with collective interests prevailing at this moment, to the detriment of the individual”, he wrote.

Garcia also stated that there are precedents for preventive arrests in cases of splits, with consequences lower than those in the case involving the businessman, in which there was a fatal victim and a person seriously injured.

When deciding on preventive detention, which is ordered to occur immediately, the São Paulo Court of Justice revokes the precautionary measures to which Fernando Sastre was bound. The decision, however, only maintains the R$500,000 bail that was already charged to the businessman.
