The judge’s decision cites witness reports that the Porsche driver was drunk and “couldn’t even stop standing up.” The document also mentions the fact that he was traveling at a speed above 156 km/h at the time of the collision — the speed allowed on the road where the crash occurred is 50 km/h. Furthermore, Fernando had in his history fines for speeding and even a “racha” on Avenida Paulista.

“The connection with similar acts, even when urged by people not to drive, due to their condition (also indicated by the gas station attendant, who saw the defendant staggering away), makes one believe in the possibility of reiterating non-compliance with rules”, narrates the precautionary arrest decision .

Defense was sought and did not respond until the publication of this text.

The decision cites a change in the testimony of one of the witnesses. In the complaint, the MP (Public Prosecutor’s Office) had reported that the businessman pressured his girlfriend to deny that he was drunk when he was driving the Porsche to justify the arrest request.

When filing a complaint, the prosecution noted that the driver of the Porsche drank alcohol in two establishments before driving. “His girlfriend and a couple of friends tried to dissuade him from driving, but the driver still chose to take the risk.”
