Proposal to increase the power of the PM has already been tested and failed in SP

The measure was limited to some areas of the state for implementation in a pilot model. It was adopted, for example, in Itaquera, in the east zone of the capital, in Guarulhos, in Greater São Paulo and, in São José do Rio Preto, in the interior. The experiment lasted 180 days, starting on December 1, 2001, and was extended for the same period in May 2002.

In 2003, the SSP (Public Security Secretariat) definitively established the resolution. The then secretary Saulo de Castro Abreu Filho, from the Alckmin government, justified the measure, among other reasons, saying that “the preparation of Detailed Terms by a civil or military police officer at the location of the events significantly reduces the time spent responding to police incidents, allowing the reduction of State spending on fuel consumption and the use of human resources, also preventing certain areas from remaining for a long time without the presence of military police”.

The measure was banned in 2009, during the José Serra (PSDB) government, following relationship problems between the two corporations. Resolution signed by the then Secretary of Public Security Antonio Ferreira Pinto stated that the tests carried out demonstrated that the “relationship between police institutions was affected in a sensitive way, with increasing friction, resulting in attitudes that harm the good progress of the police service, to the detriment of the interest public”.

The secretary explained at the time that a soldier, corporal or sergeant did not know how to characterize an illegality for assuming such a role. Ferreira Pinto was a PM officer, but built his career in the Public Ministry.

Understand the case

Management Tarcísio wanted to give investigative power to the PM. A document signed by the deputy general commander of the PM, Colonel José Augusto Coutinho, provided that military police officers would be trained to draw up TCOs, in addition to taking due diligence, that is, investigative actions requested by the Public Ministry or the Judiciary, duties that are currently exclusive to the Civil police.
