With the judgment, the Supreme Court is clearly saying that article 142 does not give the Armed Forces the attribution of moderating power. Article 142 says that the Armed Forces are permanent and regular national institutions organized on the basis of hierarchy and discipline under the supreme authority of the President of the Republic. It also says that they are intended to defend the country against external enemies, but it says that they are intended to guarantee constitutional powers. In fact, they do not have to guarantee any constitutional power. What the Republic is is the Constitution and the powers themselves are the guarantee. Kennedy Alencar

After the STF’s decision, there is a division within the government’s own base over whether or not there is a need to change Article 142 of the Constitution. The columnist for UOLhowever, highlighted that it is urgent to end the GLO (Guarantee of Law and Order), which is a type of policing operation carried out by the Armed Forces.

Senator Randolfe Rodrigues, for example, says that he should not change so as not to provide a receipt that the Armed Forces had this power and Jaques Wagner is also against it. On the other hand, Flávio Dino and some people from the PT think it is important to change article 142 to eliminate the idea that the Armed Forces are intended to guarantee constitutional powers and law and order. If you remove this part, you also have to end GLO and Múcio, for example, thinks it doesn’t have to end. I think the military was not designed to act in public security and the GLO needs to be put an end to it. When the Supreme Court makes a decision like this, it is saying that this is a dead letter in the Constitution. Kennedy Alencar
