The Minister of the Federal Supreme Court (STF) Lus Roberto Barroso suspended the requirement of Law nº 14.314/2022, which creates the national level of nursing, and gave a period of 60 days for the Union and other public and private entities to manifest themselves in the process. The decision was published this Sunday (4/9) and will still be submitted to the plenary.

On August 10, the National Health Confederation (CNSade) and seven other entities, including the Brazilian Federation of Hospitals (FBH), asked for the suspension of Law No. 75% of this amount for nursing technicians and 50% for nursing assistants and midwives.

However, the minister’s decision in the Constitutionality Directive (ADI) 7222 has not yet analyzed the constitutionality of the new legislation, extending the defense period. The decision will be taken to the virtual plenary in the next few days. If maintained, at the end of the 60 days, Barroso must reassess the case.

Minister Barroso’s decision indicates that private and public entities must send explanations, within 60 days, on topics related to the various effects of the law. Only the National Confederation of Municipalities (CNM) and the Ministry of Economy will be notified about the financial impact of the rule in the 26 states and the Federal District.

The Ministry of Labor and the National Confederation of Health Workers (CNTS) will have to analyze the risks of layoffs. Finally, the Ministry of Health, councils in the health area and the Brazilian Federation of Hospitals (FBH) will need to clarify the closure of beds and also the reduction of staff.
