A survey carried out by the Notary College of Brazil – Federal Council (CNB-CF), an entity that represents the country’s notaries, shows that the number of notarial minutes carried out in the Federal District until August 2022 is 26% higher than that recorded in 2021 A notarial act is a public instrument in which the notary documents, impartially, a fact, situation or circumstance witnessed by him. The document is a way of perpetuating the fact officially.

In absolute numbers, 1,116 acts were carried out in the first 8 months of this year, compared to 883 carried out in the same period last year.

Normally, notarial acts are used to prove the existence and content of websites on the internet, or messages on cell phones, to prove the holding of meetings of legal entities, to prove the state of real estate in the delivery of keys, to certify the presence of a person in a certain place or the occurrence of any event.

The survey, according to the CNB-CF, points to a continuous growth trend, but that is always accentuated on the eve of the elections, when the so-called fake news and virtual attacks between candidates and their sympathizers gained greater projection.

In the 2018 gubernatorial race, the year in which fake news had the greatest repercussion, the number of notarial minutes grew by 617% compared to four years earlier, rising to 998 documents issued by the notary’s offices of the country’s capital.

Following the growth trend, even in the midst of the pandemic, notarial acts, now also made online by the e-Notarial platform, reached the mark of 1,501 acts last year.

“In the current scenario, where the internet has a great role in relationships between people and in business, the notarial act has become a safe tool, increasingly sought after to guarantee legal support and protection to citizens, constituting itself as proof of facts. to be taken to court”, explains the president of the CNB-CF, Giselle Oliveira de Barros.

Regulated by article 384 of the Code of Civil Procedure (CPC), the notarial act is intended to certify public faith in a given event, in order to pre-constitute evidence to be used in legal proceedings.
