The Regional Council of Medicine of Pernambuco (Cremepe) filed, this Thursday (09), a public civil action against the Government of Pernambuco to ensure measures that guarantee the functioning of elective services in the Barão de Lucena Hospital, in the Iputinga neighborhood, in Recife.

According to Cremepe, the Pernambuco State Health Department and the Management of Hospital Barão de Lucena (HBL) refused to sign the commitment that would allow the resumption of elective services at the health unit.

Cremepe informed that the action filed presents “the Council’s inspection reports that recorded, since December 2023, a situation that reflects a serious problem in the functioning and supply of medicines and supplies at the Hospital and appeals to the Court, for the adoption of effective measures in order to remedy the irregularities”.

Furthermore, the document demands the granting of an Injunction so that patients have access to medicines and supplies; emergency beds and space in the intensive care unit.

“In view of the above, the Author requests, hopes and trusts that the requested injunction be granted, to immediately fulfill the obligation to assist patients with medicines and supplies, guarantee emergency beds as well as places in intensive care units, under penalty of fine (…) in case the Defendant fails to comply with the court order, as well as for Your Excellency to determine compliance with the court order under penalty of the person responsible being charged with the crime of disobedience and obstruction of justice, as well as administrative improbity ”, requests Cremepe in court.

By means of a note, the State Department of Health reported thatand “to date, the public civil action has not been officially notified”.

Understand the case

A partial ethical ban was placed by Cremepe at Hospital Barão de Lucena on the day January 17th this year due to “a series of serious problems recorded after inspections”.

The ban occurs when sectors of a certain medical care or hospital establishment are unviable for medical professional practice.

According to the Council, the unit, which is part of the state health network, suffers from a major shortage of medicines and basic supplies. The measure taken by Cremepe had already been notified last December to the complex’s management, who had 30 days to resolve the problems.

Cremepe highlighted that “the ban aimed to preserve the dignity of care for the population and the safety of the medical procedure.”

The measure suspended medical work in hospitalizations for programmable elective surgeries, with the exception of oncological surgeries and critical vascular ischemia, with all others having to be immediately communicated to Cremepe, accompanied by an effective justification of their need, with a view to directing resources in critical stock to the urgency and emergency sectors.

New meetings and inspections were held with the clinical staff and hospital managers, but Crempe “confirmed the impossibility of lifting the ethical ban”.
