Family of man victim of Porsche accident seeks compensation

In addition to alimony corresponding to 3 minimum wages, family members request payment of R$5 million for moral damages

The family of app driver Ornaldo da Silva Viana, who died in the accident caused by businessman Fernando Sastre de Andrade Filho, who was driving a Porsche at high speed in the east zone of São Paulo, filed a lawsuit to collect payment of R$ 5 million in compensation for damages.

In addition to this amount, which must be paid to Ornaldo’s family, the lawyers ask that Sastre pay food payments to the victim’s wife and his teenage daughter, who live in Guarulhos.

Last Tuesday (May 7) the STJ (Superior Court of Justice) denied the request for habeas corpus made by Sastre’s defense.

“Prosecutor Fernando Bolque spoke out in favor of granting an injunction so that the driver of the Porsche involved in a collision on March 31 in São Paulo is obliged to pay a provisional pension of three minimum wages to family members of the app driver who died. with the collision between cars”reported the MPSP (Public Ministry of São Paulo).

Sastre was arrested 1 day earlier (May 6) by the São Paulo Civil Police and underwent a custody hearing on Tuesday afternoon (May 7) to verify whether any illegality had been committed in executing the arrest warrant.

The driver of the Porsche surrendered to the Court at the 5th East Sectional Police Station, in Tatuapé, and spent the night at the 31st Police Station, in Vila Carrão, after being on the run for 3 days, as on Friday (May 3) the Court decreed his arrest and he was not found by the Civil Police at his home on Saturday (May 4).
