Judge will fill the vacancy left by judge Jaime Ferreira Abreu, retired after reaching maximum age in the judiciary

Judge Heloísa Cariello was elected the new judge of the Espírito Santo Court of Justice (TJES). The vote took place at the Court’s Full Court session this Thursday (9). The selection criterion used was merit.
The judge received 21 votes from the judges, who were able to vote for up to three names on the list of 16 judges registered to ascend to a seat on the Court.
The vacancy that will be occupied by Heloísa Cariello belonged to judge Jaime Ferreira Abreu, who left the post in February this year, after turning 75, the age at which magistrates are compulsorily retired.
The notice that opened space for the election of a new judge at the Court is considered unprecedented. This is because the document published in March this year, as reported by columnist Letícia Gonçalves, made the choice of a woman mandatory for the open position in the state Court.
The initiative complied with the provisions of a resolution approved and instituted by the National Council of Justice (CNJ) in September 2023. The CNJ resolution ended up creating the policy of alternating gender when filling vacancies for the second instance of the Judiciary, as is the case of TJES.
As a result, the courts are obliged to use the women-only list, alternately, with the traditional mixed list, in promotions based on merit.
Shortly after the announcement that the new TJES judge had been chosen, Heloísa Cariello, who was at the session, appeared emotional. When providing a legal commitment to the other judges, the judge said that she will always comply with the Federal Constitution and that she will faithfully fulfill her role.
In her CV, the judge, who is 58 years old and born in Vitória, has experience as a substitute judge, assistant judge at the TJES and the General Inspectorate of Justice and substitute judge at the Regional Electoral Court (TRE-ES). She has also served as a substitute for other judges on the Court’s Plenum.
