A petition from Sintrajufe/RS was filed this Friday, the 26th, with the TRF4, requesting that the court pay the retroactive payments of fifths to civil servants who still have outstanding amounts. In four days, the document registered 179 signatures, with the support of colleagues from Rio Grande do Sul, Santa Catarina and Paraná.

At the end of last year, the Federal Justice Council (CJF) authorized the payment of these amounts, as guaranteed by law 14,687/2023, but the court did not make it effective for all civil servants covered. In a meeting with Sintrajufe/RS, on the 9th, the president of the TRF4, judge Fernando Quadros da Silva, explained that he defends the extension for everyone and that his intention would be to consult the CJF ministers on the topic and bring it to the agenda at the meeting of the Council that will take place next Monday, 29.

At the time, the union’s management recalled that the CJF had already authorized the payment and highlighted that the same decision that authorized the payment in Paraná could be used for payment in Rio Grande do Sul and Santa Catarina. With the speech of the representatives of Sintrajufe/RS, the judge committed to considering a referral in this direction, pointing out that, even so, before making any decision, he would seek the Presidency of the CJF to deal with the matter.

20 years without a definitive solution

In the petition, it is explained that, at the end of 2023, the CJF decided to pay retroactive amounts of “fifths” to colleagues who did not execute amounts through the courts. Following this decision, the TRF4 settled amounts, but only for male and female employees of the Judiciary Section of Paraná, which constitutes unequal treatment.

The document also points out that the claim affects a small number of civil servants, as the majority of those involved have already secured their right through the courts. The incorporation of fifths is the subject of administrative and judicial demands relating to the period from 1998 to 2001, that is, it has been more than 20 years without a definitive solution for a portion of the category.
