OAB-MG guarantees funding of R$90 million to pay native lawyers

Native lawyers, who are professionals appointed by judges to work in legal processes serving the needy population, complain that since 2013 they have not been receiving their fees administratively. The management of OAB-MG, which took office in 2022, is working to change the situation. So much so that it provided the amount of R$2 million per month to remunerate this group of lawyers.

On the morning of this Wednesday (24), a meeting held at Palácio Tiradentes, in the Administrative City, guaranteed the payment of R$9 million per month until the end of 2024, which ensures the payment of these fees.

For the president of OAB-MG, Sérgio Leonardo, “this day is historic, the most important of the administration that began in 2022 under the motto of ‘Innovate, Include and Advance’. For this, I thank governor Zema, the vice-governor, Mateus Simões, AGE and the secretaries who were at the forefront of this initiative that has a real impact on society and law”.

The agreement that changes the budget allocation was signed between OAB-MG, the state government, the State Attorney General’s Office and the Court of Justice of Minas Gerais. Participating in this meeting were the Secretary General of the State of Minas Gerais, Marcel Beghini, the Secretary of State for Planning and Management, Luísa Barreto; the State’s attorney general, Sérgio Pessoa; the Deputy Attorney General, Fábio Murilo Nazar; and the chief of staff of the General Secretariat, Ana Tereza Ribeiro Fernandes.

President Sérgio Leonardo continues to state that “if we add up all the resources paid since the Law on Donations was approved (1999) there is no comparison or precedent in history. The payment of donations not only values ​​the work of lawyers, but also guarantees the effective judicial provision, promoting a more just and egalitarian society”.

The general secretary director of OAB-MG, Sanders Alves, who was in charge of the negotiation since the beginning (2022), highlighted the stages of this evolution process carried out with the Attorney General’s Office and the Court of Justice. “In 2022, the Order guaranteed an amount of R$17.2 million. The following year, R$34 million administratively and R$10 million through joint efforts, totaling R$44 million until last year”, informed Sanders.

For the Secretary General of the State, Marcel Dornas Beghini, it is a moment of opportunity and significant transformation, both for lawyers and citizens. “This is a transformative movement. I also see that other previous managers did not prioritize the situation of data with the same attention, but this is changing. This support for private lawyers is very important and relevant”, he concluded.

Evolution of payment of assets between 2022 and 2024

2022
April – Signed Addendum to the Mutual Cooperation Agreement signed between OAB-MG, Court of Justice of Minas Gerais (TJMG) and General Attorney’s Office of the State of Minas Gerais (AGE-MG), which made R$2 million available monthly for the administrative payment of legal fees. The agreement guaranteed the readjustment of the dative fee table according to the Special Broad Consumer Price Index (IPCA-E) and created the single certificate to speed up payments to lawyers.

August – Joint decree signed to issue the Certificate of Payment of Lawyers’ Fees (CPHA) for legal practice. The document regulates payment procedures and establishes the rules for issuing the CPHA, by the secretariats of the judicial units, through the Unified Repository of Electronic Procedures – RUPE, for each appointment and exclusively, following a single, general and standardized model.

November – OAB-MG opened registrations for the formation of a Dativa Advocacy List that will provide legal assistance to the low-income population in Minas Gerais. OAB-MG, TJMG and AGE-MG signed a technical cooperation agreement to carry out a joint effort to reconcile processes involving the payment of attorneys’ fees.

2023
February – Start of the joint effort to conciliate processes involving the payment of attorneys’ fees.

March – Creation of an information center by TJMG so that lawyers have access to the CPHA payment progress made through the Unified Repository of Electronic Procedures (RUPE). System corrections are planned to enable online consultation.

May – Signed Technical and Operational Mutual Cooperation Agreement for the annual update of the 2023 grant table of fees by IPCA-E.

November – OAB-MG opens registration for the formation of the Dativa Advocacy List – Notice 2023-2024, which will provide legal assistance to the low-income population in Minas Gerais.
