MPF-ES requests compensation and vacancy of the Recreio de Setiba subdivision

The Recreio de Setiba subdivision, located on ES-060, close to the Guarapari border, has an embargoed area following a final court decision. The Federal Public Ministry (MPF-ES) requested the Federal Court that the sentence be effectively carried out by the 28 owners of properties built illegally in the region.

The MPF-ES alleges that, in 1980, the construction of the subdivision took place close to the Paulo César Vinha State Park, causing significant environmental damage.

After 24 years of the last sentence, which halted deforestation and required the recovery of already degraded areas, the MPF-ES requested the Court that the companies responsible for the subdivision pay compensation of R$1 million, in addition to vacating the region due to the damage. caused to the ecosystem.

During the period, it was found that part of the land was occupied irregularly, identifying the owners of the lots, who could be targets of future legal measures if damage to the area is confirmed.

The federal agency argues that the region should be considered a Buffer Zone or Buffer Zone for the state park, serving as a protective margin for the conservation unit, aiming to minimize negative impacts on it.

In 1986, the Brazilian Institute of Forestry Development (IBDF), currently known as the Brazilian Institute of the Environment and Renewable Natural Resources (Ibama), notified the company Conterra Construções e Terraplanagens to stop deforestation in the Recreio de Setiba Loteamento.

After legal action and appeals, deforestation was temporarily suspended, but resumed in 1988, resulting in a new embargo. In 2000, a ruling prohibited companies from continuing with deforestation and demanded the recovery of degraded areas, with payment of compensation for damages.
