Court suspends signing of concession contract for the Intercidades Train between SP and Campinas | Campinas and Region

The Justice suspended, on Tuesday night (23), the signing of the concession contract for the Intercidades Train, which plans to connect São Paulo to Campinas (SP) from 2031. The decision responds to a request from the São Paulo Railway Workers Union (STEFSP). The state government stated, in a statement, that it will appeal.

Gabriel Oliveira Sampaio, one of the union’s lawyers, told g1 this Wednesday morning (24) that the main reason for the suspension request is that the state government called on the consortium to sign the contract and, if the document was signed , the agreement would be completed and the entity’s questions regarding the auction would become meaningless.

The union took legal action to question the auction because the C2 consortium was the only consortium in the bid, which, according to the entity, “frustrates the competitive nature of the bidding”. “The writ of mandamus exposes 13 main illegalities and irregularities contained in the Notice and in the conduct of the Bidding itself by the state government,” said Sampaio.

In the decision, judge Simone Gomes Rodrigues Casoretti, from the 9th Public Finance Court of São Paulo, understands that the writ of mandamus “would lose its purpose” if the contract was signed.

“Thus, to avoid the ineffectiveness of the measure, as with the signature the writ of mandamus loses its purpose, I order the suspension of the signing of the contract until the information is provided and the merits can be analyzed”, says the judge in the text of the decision .

The Secretariat for Investment Partnerships (SPI) reported that the “decision was made within the deadline for the state government to express its opinion, without analyzing the contradiction” and, therefore, will appeal.

The suspension also includes the concession of Line 7 – Rúbi, between São Paulo and Jundiaí. The Tem Intercidades project will cost R$14.2 billion.

Auction defines group that will manage intercity trains

The state government will pay R$8.9 billion – R$6.4 billion with money from BNDES, which is part of the growth acceleration program. To guarantee the operation, the state would pay a maximum of R$8 billion over the course of the contract. The consortium that won agreed to receive R$7.2 billion.

The decision to implement a train between Campinas and São Paulo has been going on for at least 20 years. Journeys will last 1 hour and 4 minutes, with maximum speed trains of up to 140 km/h and a fare of R$64.

The proposal is for express service trips to have 15-minute intervals at peak times.

The state foresees that the express service (SP and Campinas in 64 minutes) will be served by a train with a capacity for 860 seated passengers, operating at intervals of up to 15 minutes during peak hours. The project is expected to serve up to 60 thousand passengers per day on all services.

What are the planned connections?

  • Express Service (Intercity Train): São Paulo to Campinas, with a stop in Jundiaí;
  • Initial Line 7 Service and Line 7-Rubi Service: connect Barra Funda Station, in São Paulo, to Jundiaí, and serves the cities of Franco da Rocha, Francisco Morato, Campo Limpo Paulista and Várzea Paulista;
  • TIM Service (Intermetropolitan Train): goes from Jundiaí to Campinas, and also serves Louveira, Vinhedo and Valinhos.
