Moraes frees PMDF colonels accused of omission on January 8

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), ordered the release, this Thursday (28), of three colonels from the Military Police of the Federal District (PMDF) who are defendants accused of omission during the coup acts of January 8 last year, when the headquarters of the Three Powers were invaded and vandalized. They were trapped in Brasília.

Colonels Fábio Augusto Vieira (former general commander of the PM) and Klepter Rosa (former deputy commander) were released. Colonel Marcelo Casimiro also benefited. The three will have to wear an electronic ankle bracelet and are prohibited from using social media or communicating with each other.

According to Moraes’ order, they are also subject to nightly detention, are prohibited from leaving the Federal District, must surrender their passports and present themselves to the Court weekly.

When releasing the three colonels, Moraes wrote that they no longer pose risks to the prosecution of criminal proceedings, as they have been placed in the paid reserve. The minister also cited a “total restructuring of the command of the Military Police in the Federal District”. They had been arrested in August 2023, in Operation Inúria.

Omission

The three colonels were part of the PMDF leadership during the coup acts and were denounced by the Attorney General’s Office (PGR) for failure to commit crimes of coup d’état, violent abolition of the Democratic Rule of Law, qualified damage, deterioration of the Union’s listed heritage and violation of functional duties.

According to the indictment, they had been conspiring since the previous year in favor of a pro-Bolsonaro popular uprising and, on January 8, they deliberately allowed the crimes to be committed.

The PGR said there was “a deep ideological contamination on the part of the PMDF officers reported, who showed themselves to be supporters of conspiracy theories about electoral fraud and coup theories”.

In February, the First Panel of the Supreme Court accepted the complaint against the three and other members of the PMDF.
