A radar recorded the moment when the passenger of a vehicle fined for speeding he lowered his pants and showed his private parts towards the inspection on Avenida Prestes Maia, in Campinas (SP).
The case occurred in January this year, but the images recently went viral on social media. For lawyer João Sangion, the man may be held liable for an obscene act if there is a complaint and if the Court understands that there was a conscious intention to do so.
“You can configure the intent, depending on the agent’s will. In this case, it seems to me to be a game like the radar, with the photo that will come out. I, in a defense as a lawyer, would maintain that there is no crime of an obscene act, because the intent his is not an obscene act”, he explains.
Sangion adds that the case could also be classified as an obscene act if there was a vehicle behind that could see the scene. In this situation, the passenger would be taking the risk of being seen by other drivers.

Vehicle seized after 7 fines
In a note, the Municipal Development Company of Campinas (Emdec), responsible for traffic in the metropolis, highlighted that “the vehicle was seized with a history of seven infractions committed between May 2020 and January 2024, which amounted to more than R$1,300 in fines”.
The municipality highlighted that “in principle, the situation is handled by Emdec only in the sphere of traffic violations and follows conventional procedures, including due to the automatic processing of notifications.”
Emdec classified the case as a “provocation”but warned that “the act puts the safety of those doing it and other traffic actors at risk, as it could result in an accident”.
