Project aims to increase penalties for spouses who intentionally transmit STDs and STIs to their partner

PL nº 652/24 is being processed in the Chamber of Deputies, which intends to more rigorously punish the spouse or partner who knowingly transmits Sexually Transmitted Diseases (STDs) or Sexually Transmitted Infections (STIs) to their partner. The proposal foresees, in these cases, an increase in the penalty by up to two thirds.

Currently, the Penal Code provides for imprisonment of two to eight years for the crime of serious bodily injury that results in an incurable illness and imprisonment for one to four years for anyone who knowingly transmits a serious illness to another person.

The project, which is under analysis in the Chamber of Deputies, was presented by deputy Geraldo Resende (PSDB-MS), which aims to combat mainly cases of AIDS transmission in marital relations. “Free and conscious transmission carried out by a spouse or partner who is previously aware of their infection, through the practice of unprotected sexual relations, must be punished more rigorously.”

The project will be analyzed by the Constitution, Justice and Citizenship Committee, before being voted on by the Plenary.
