SP court orders arrest of Porsche driver who caused fatal accident

247 – The São Paulo Court of Justice ordered the preventive arrest of Fernando Sastre de Andrade Filho, driver of the Porsche involved in a fatal accident last month, in the East Zone of São Paulo, reports the g1 portal. The decision was taken this Friday (3), after the Public Ministry (MP) appealed against the Court’s refusal to grant the preventive detention requested by the Civil Police.

The determination was made by judge João Augusto Garcia, who granted an injunction to give active effect to the appeal in the strict sense, decreeing the arrest of Fernando Sastre Filho. The magistrate also revoked previous precautionary measures, such as the suspension of the driver’s license and the ban on approaching witnesses, and maintained the bail payment of R$500,000.

The accident resulted in the death of app driver Ornaldo da Silva Viana and serious injuries to medical student Marcus Vinicius Machado Rocha, a passenger in the Porsche. Prosecutor Monique Ratton argued that the case met the requirements for preventive detention, citing the accused’s influence on witness testimony and his history involving other automobile accidents.

Fernando Sastre Filho was charged with qualified intentional homicide and serious bodily injury, in the form of possible intent. The police investigation concluded that the businessman was arrested and presented to the police only 36 hours after the accident. The Public Prosecutor’s Office alleges that the driver took the risk by driving under the influence of alcohol and at high speed, exceeding 150 km/h.

Fernando Sastre Filho’s lawyer announced that he will file a habeas corpus petition with the Superior Court of Justice in the next few hours. The accident occurred on March 31 on Avenida Salim Farah Maluf, where the Porsche collided with a Renault Sandero. The accused’s mother was also charged with fleeing the scene of the accident.
