SP court prohibits ex-wife of Porsche owner from speaking about allegations of threats and aggression

The São Paulo court banned model Eliziany Silva from speaking publicly about the accusations of aggression, threats, torture, kidnapping and psychological abuse that she allegedly suffered from Fernando Sastre de Andrade, father of Fernando Sastre de Andrade Filho – driver of the Porsche involved in the accident that resulted in the death of the app driver in March, in the East Zone of the capital of São Paulo.

According to information from the newspaper The globe, Fernando Sastre de Andrade, owner of the luxury vehicle that his son was driving during the accident, was accused by Eliziany of a series of crimes. The accusations are recorded in two police reports.

After father and son went to court to prevent Eliziany from commenting on the matter publicly, a decision from the 3rd Civil Court on Monday, 29, granted their request. In the petition, they argued that the facts are confidential in legal proceedings. Now, it is prohibited from disclosing videos, audios, documents or any content related to the confidential processes in question.

“From the analysis of the links to the reports brought to the file, I observe that the defendant’s statements and the transfer of private photographs and videos that appear in legal actions covered by judicial secrecy, only after the involvement of co-author Fernando in an accident of great national repercussion, suggest a possible attempt to tarnish the image of the authors for facts still under discussion with the aim of obtaining some benefit. If the disclosure continues as carried out, the damage to the image, honor and morals of the authors is unequivocal, even influencing the business activity carried out by them, affecting third parties unrelated to the disagreement between the parties”, highlighted the judge in the decision. The judge, however, did not accept the request to prohibit the model from mentioning the names of Fernando Sastre and Fernando Sastre Filho.

The court determined that, in case of non-compliance, the model will have to pay a fine of R$5,000.00 for each violation.

Fernando Sastre de Andrade, the father of the Porsche driver who killed an app driver last month, in the East Zone of São Paulo, is accused by his ex-wife of physical violence, torture, kidnapping, threats and psychological abuse. Eliziany Silva filed two police reports against him with the São Paulo Civil Police.

One of the bulletins was registered on July 12, 2023 at the 5th Police Station for the Defense of Women in São Paulo. According to the document, the woman was attacked with slaps in the face and then pushed onto the bed by the businessman. Then, he took a cell phone charger cord, making a move to choke her. Eliziany managed to escape and ran to the bathroom, where she was slapped again and Fernando tried to choke her with his hands. The woman says she needed to be treated in the emergency room at Hospital Adventista de São Paulo. The episode would have occurred on June 30, 2018.

The second bulletin was made on November 28, 2023, at the 1st Police Station for the Defense of Women. In this, Eliziany says that she went out to dinner with the businessman, her daughter and her sister on December 22, 2021. After dinner, Fernando left his stepdaughter and sister-in-law at home. Eliziany claims that she felt sick in the car and passed out and, the next day, woke up in a motel completely naked and with bleeding from her private parts.

According to the woman, she wanted to leave to seek medical attention, but Fernando made her wait for breakfast and forced her to make an online medical appointment to stop the bleeding.

According to The globe, Eliziany started dating Fernando in 2008. In 2010, they moved in together and signed a stable union with partial community of assets. They separated in 2019.

The woman tells the newspaper that both her ex-husband and Fernando Filho, the driver of the Porsche, are violent. Eliziany claims that she was also punched in the face by her stepson, but he was not included in the records made to the police.

According to the newspaper, in July last year, she requested a restrictive measure against her ex-partner, but was denied. Currently, the two are fighting in court over a division of assets valued at more than R$30 million. Fernando Sr. told the newspaper that he would not comment because the legal dispute with his ex-wife is under secrecy.

To the Earth, the Civil Police confirmed that two police reports were located against Fernando. “Both cases are investigated through a police investigation, initiated by the 5th Police Station for the Defense of Women (DDM). The investigations to investigate the crime of domestic violence are being carried out under judicial secrecy”, informed the corporation.
