Police ask for the arrest of the Porsche driver for the third time

The São Paulo Civil Police requested, for the third time, the arrest of Fernando Sastre Filho, aged 24, who caused the accident that cost the life of app driver Ornaldo da Silva Viana — who was in the Renault Sandero hit by the businessman’s Porsche , in Tatuapé, a neighborhood in the East Zone of São Paulo. The tragedy happened in the early hours of March 31st. Previously, two other requests for arrest (one temporary and the other preventive) were denied by the courts. Fernando’s mother, Daniela Cristina de Medeiros Andrade, was also indicted.

The owner of the Porsche was being investigated for the crimes of homicide, bodily harm — due to the injuries caused to Marcos Vinicius Machado Rocha, who was with him in the car — and fleeing the scene of the crime — he did not provide assistance and did not take a breathalyzer. With the conclusion of the investigation, it is up to the Public Ministry of the State of São Paulo (MP-SP) to decide whether to denounce Fernando for the three crimes, in addition to agreeing or not with the new arrest request.

Images from the body cameras of the police officers who responded to the incident show that Fernando was released without any problems. The businessman did not even take a breathalyzer test and was accompanied by his mother, who urged the agent to register the incident under the allegation that she was taking her son to be treated at a hospital — which was not done.

The images initially show Fernando and Daniele leaving the scene of the disaster — when they were called by the police, who were listening to witnesses, and had to return. While the agent was interrogating the businessman, a witness intervened and said he saw the Porsche pass at high speed, shortly before hitting Ornaldo’s Sandero. “This guy flew by”, she says, pointing at Fernando. The agents’ procedure does not change.

The businessman answers the police officer’s questions. The mother intervenes at times: she says that all of Fernando’s details had been provided and insists that her number be registered as a contact telephone number. The other agent in the pair only follows the interrogation.

At one point, the police officer wants to know from Fernando what happened. “We were leaving the party. We were going to my house to play pool. Then, out of nowhere, a horrible accident happened and… This happened. I don’t remember anything anymore”, she reported.

Then, Daniele asks the police officer “for the love of God” to release them so Fernando can go to a hospital. “If he has hit his head, every minute counts”, insists Daniele, showing impatience.

At no point do the agents ask Fernando to take a breathalyzer test. In the end, the police officer says to the Porsche driver: “Read if that’s what you told me and then sign it” — and shows the device on which she recorded the incident. The mother approaches and also reads the record. “That’s it”, concludes the businessman, who signs the document.

From then on, Fernando is free. The police officer asks Daniele where she would take her son and hears that she was going to the hospital — which was not done.
