Senate CCJ postpones analysis of proposal that resumes DPVAT charges | Policy

The Senate Constitution and Justice Committee (CCJ) postponed this Wednesday (24) the analysis of the project that resumes insurance for victims of traffic accidents, known as DPVAT.

The postponement of the discussion was suggested by the government leader in the House and rapporteur of the proposal in the collegiate, senator Jaques Wagner (PT-BA).

The government was counting on the approval of the proposal by the CCJ and the Senate plenary this Wednesday.

This is before the joint session of Congress – scheduled for tonight – in which vetoes by President Luiz Inácio Lula da Silva (PT) must be analyzed.

Last week, the president of the CCJ, senator Davi Alcolumbre (União Brasil-AP), even announced a preliminary agreement to settle the analysis of the project this Wednesday.

At the opening of the session, however, Alcolumbre reconsidered a measure that provided for a shorter deadline for analyzing the text.

Behind the scenes, the assessment is that the removal of the project from the agenda and the postponement of the analysis are part of a movement to postpone the Congress session.

On Tuesday (23), according to interlocutors, the government leader in Congress, senator Randolfe Rodrigues (no party-AP), even asked the president of Congress, senator Rodrigo Pacheco (PSD-MG), to postpone the session of vetoes.

Pacheco conditioned the postponement on the approval of parliamentarians from the Chamber of Deputies, who are meeting this Wednesday to evaluate the Congress’s agenda.

Early in the morning, assistants to the president of Congress stated that there was a “50% chance” of postponing the meeting intended to analyze the vetoes. The senator hasn’t hit the gavel yet.

Federal Senate analyzes return of DPVAT Insurance collection; understand bill

The proposal that revives the DPVAT was approved by the Chamber of Deputies at the beginning of this month.

According to the proposal, the instrument will be called Compulsory Insurance for the Protection of Traffic Accident Victims (SPVAT). Hiring will be mandatory for all car and motorcycle owners.

SPVAT coverage may pay compensation for:

  • death
  • permanent, total or partial disability
  • and reimbursement of expenses for medical assistance, funeral services and professional rehabilitation of victims

The amounts of compensation and insurance are not defined in the proposal and must be established in subsequent regulations. SPVAT will be managed by Caixa Econômica Federal.

With the new regulations, it will be possible to once again charge mandatory insurance to all motor vehicle owners and the premiums will be administered by Caixa in a new fund now called Mandatory Insurance for the Protection of Traffic Accident Victims (SPVAT).

Charge extinguished in 2020

The DPVAT charge was abolished during the government of President Jair Bolsonaro (PL). The last time vehicle owners paid the DPVAT was in 2020. Since 2021, management of the remaining balance has passed from the Líder insurance company to Caixa Econômica Federal.

At the beginning of this year, however, the Lula government reported that resources were running out. With that, he sent a complementary bill to Congress to recreate the insurance.

At the request of the government, during the analysis in the Chamber, a device was included that, in practice, allows the government to increase spending in 2024, in a value of approximately R$15.7 billion. The measure modifies the new tax framework.

According to the current rule, Planalto can only open additional credit if the revenue assessment is positive in the Budget report for the second two months, scheduled for May 22nd.

In the text approved by the deputies, the government will be able to advance the credit, based on the first bimonthly assessment of income and expenses, published on March 22nd.
