Santa Cruz da Baixa Verde City Hall should also not make new temporary hires to carry out permanent activities.
05/09/2024 – The Public Ministry of Pernambuco (MPPE) recommended to the mayor of Santa Cruz da Baixa Verde to implement measures to correct irregularities in the municipality’s personnel management.
The first step recommended by the MPPE to municipal management is not to make new appointments to commission positions, especially those of office officer, vehicle driver, office assistant and administrative assistant, since they have typical duties whose service provision must be carried out by permanent employees admitted through a public competition.
Similarly, the Municipality of Santa Cruz da Baixa Verde should also not make new temporary hires to carry out permanent activities.
According to Public Prosecutor Carlênio Brandão, these irregularities were discovered during the course of a civil investigation established to investigate the legality of hiring in the civil service of the Triunfo and Santa Cruz da Baixa Verde City Councils.
“Complementary Law No. 01/2006, which reorganized the administrative structure of Santa Cruz da Baixa Verde, provides for commissioned positions whose duties are not related to the functions of advisory, leadership or direction, as provided for in the Federal Constitution. In addition, we identified civil servants temporary employees carrying out ongoing activities, which must be carried out by civil servants admitted through a public examination. The municipality does not have permanent positions in the areas of Health, Social Services and Psychology, for example”, warned the Prosecutor, in the text of the recommendation.
In order to correct this situation, the last measure recommended by the Public Ministry is the initiation, by municipal management, of the legislative process to review Complementary Law No. 01/2006.
Among the priorities are eliminating the commissioned positions of office officer, vehicle driver, office assistant and administrative assistant; grant responsibilities to the positions of municipal legal attorney, chief legal advisor and legal advisor; and repeal the inadequacies of Municipal Law No. 207/2007, in order to guarantee that the Social Security Regime Autarchy has permanent public servants on its staff.
Given the need to respect the procedures of legislative activity to promote the recommended changes, the local Public Prosecutor’s Office granted a period of 90 days for the mayor to comment on compliance with the recommendation, as well as inform the measures actually adopted.
The recommendation was published in the MPPE Official Electronic Gazette on April 30.
