STF maintains ban on politicians on state-owned companies’ boards

The Federal Supreme Court (STF) validated, this Thursday (9), an excerpt from the State Law, which prohibits appointments of politicians to the board of directors of public companies.ebc.gif?id=1594348&o=node

With the decision, appointments of politicians to state-owned companies are vetoed. However, politicians who took up positions in public companies during the injunction issued in March last year by the then STF minister Ricardo Lewandowski, which made the rule more flexible, will be able to remain in their positions.

By 8 votes to 3, the Court decided to overturn Lewandowski’s injunction. In the session on Wednesday (8), the ministers had already forwarded five votes in favor of validating the law. In the afternoon session this Thursday, the plenary concluded the trial.

Before retiring and leaving the Court, Lewandowski responded to the PCdoB’s injunction request and suspended the section of the rule that prevented ministers of state and state and municipal secretaries from serving on the boards of directors and boards of directors of state-owned companies.

The injunction, however, maintained the prohibition on appointing people who still participate in the decision-making structure of parties or who have work linked to parties and political campaigns. The 36-month quarantine period for entry into public companies was also suspended by the former minister.

In light of the plenary decision, all restrictions suspended by Lewandowski’s injunction are back in effect.

However, according to the understanding of the majority of STF ministers, the indications made during the minister’s injunction cannot be considered illegal as they are supported by the decision.
