CEOF approves authorization for BRB to create a subsidiary to handle the DF Lottery

The Economy, Budget and Finance Committee (CEOF) of the Legislative Chamber of the Federal District (CLDF) approved, on the afternoon of this Tuesday (7), an authorization so that the Bank of Brasília (BRB) can create a subsidiary to take care of the future DF Lottery. The text was approved by the members of the Committee and continues to be processed by other committees until it reaches the House plenary.

The authorization is provided for in Executive Bill No. 1,081/2024, which amends Law No. 7,155/2022, which created the DF Lottery. According to the approved text, BRB is “authorized to create a subsidiary to carry out the operational activities inherent to the exploitation of lottery and similar games, including electronic games through physical and digital means”.

Change in ITBI Calculation

The CEOF also approved bill no. 885/2024, by deputy Thiago Manzoni (PL), which amends the legislation that defines the basis for calculating the Tax on the Inter Vivos Transmission of Real Estate and Related Rights (ITBI) . The project still needs to be analyzed in other committees and in the CLDF plenary.

According to the proposal, the tax calculation basis becomes “the market value of the property measured through the value of the transaction declared by the taxpayer of the tax obligation”.

In justifying the project, deputy Thiago Manzoni argued that, in March 2022, the Superior Court of Justice (STJ), established that the ITBI calculation basis is the value of the property transferred under normal market conditions, not being linked to the basis of calculating IPTU, which cannot even be used as a tax floor.
