Father is ordered to pay R$10,000 in compensation to his own daughter for emotional abandonment in MG

A man was ordered to pay R$10,000, plus interest and monetary correction, in compensation for moral damages to his own daughter, for emotional and material abandonment. The decision was released this Tuesday (May 7) by the Court of Justice of Minas Gerais (TJMG).

The Public Prosecutor’s Office for the Defense of the Rights of Children and Adolescents in Três Pontas, in the south of Minas Gerais, filed a lawsuit to demand the payment of child support, in addition to compensation for moral damages.

In a previous hearing, it was agreed to pay 30% of the minimum wage, in addition to an additional R$200 per month to cover psychological treatment. Despite having agreed to the payment of the pension, the District of Três Pontas denied the request for compensation for abandonment.

As a result, the Public Prosecutor’s Office appealed to the TJMG, requesting a review of the decision to sentence the father to pay compensation for moral damages resulting from emotional abandonment and the reduced chance of adoption, due to his age.

The TJMG ruling points out that, despite having taken care of the daughter from four to ten years old, the father chose not to resume custody after new institutionalization. “Furthermore, even the financial support determined by the Court has not been satisfactorily fulfilled by the parent, which demonstrates abandonment not only of a moral nature, but also of a material nature, with all the duties inherent to family power having been neglected.”
