Death due to dog: Unreleased video shows discussion between retiree and lawyer

New images from video surveillance cameras that were released this Tuesday (7) revealed details of the discussion between lawyer Luis Hormindo França da Costa, aged 33, and retired Manoel de Oliveira Pepino, aged 73, over a dog collar in Vitória. The fight between neighbors took place on April 20, in the Mata da Praia neighborhood, and ended with the death of Manoel. Luis Hormindo was arrested on the day of the crime and released on Friday (3).

In the camera footage, it is possible to see that the argument between the two men began at 6:19 pm. The fight was attended by Manoel’s wife, Marília Pepino. At the beginning of the recording you can hear the expressions ‘crazy’, ‘I already told you’ and ‘then you’ll say I’m wrong’. The discussion becomes heated with an exchange of insults.

Later on, it is possible to hear a dialogue between Luis Hormindo and Marília:

– “If you continue there it will be bad for him and for you”, says Marília.
– “Go, because he’s going to die”, replies the lawyer.
– “Go away, he has a gun”, warns the retiree’s wife.
– “I have it too, so what?”, says Luis.
– “Do you want to die?” asks the woman.
– “Let’s see who dies first?”, replies the neighbor.
– “You want to die, die”, says Marília.

At 6:21 pm, the lawyer appears in the video with the dog, heading in the opposite direction to the retiree’s house. Some people even pass right away. The first shots are heard at 6:23 pm, the noise scares pedestrians passing by. The elderly man then appears also going to the right corner of the image and from there the two do not appear again in the recording.

The Civil Police of Espírito Santo (PCES), through the Specialized Homicide and Personal Protection Division (DHPP) of Vitória, reported this Tuesday (7) that it concluded the police investigation that investigated the death of businessman Manoel de Oliveira Pepino , which took place on April 20th in the Mata da Praia neighborhood, in Vitória.

According to the corporation, the lawyer acted in self-defense when he shot and killed retired Manoel.

The Public Ministry of the State of Espírito Santo (MPES) reported that it forwarded the Police Inquiry to the Civil Police and requested that further steps be taken to investigate the facts. In other words, it demands more investigations into the crime.

Because of this, and as there was no legal support to maintain the lawyer’s precautionary detention, the MPES requested his release with the fulfillment of precautionary measures, such as handing over all weapons he may have; ban on attending shooting clubs; and prohibition on visiting any place where firearms are sold.

It was also understood that it was not necessary to suspend the activity of a lawyer, as there was no relationship between the facts and professional practice.

Therefore, the police investigation will continue in progress and, upon completion, it will be forwarded again to the MPES, for analysis and adoption of the appropriate measures.

Videos show shooting between lawyer and retiree in Vitória

In one of the videos it is possible to see the moment in which lawyer Luis Hormindo França da Costa appears holding his dog and with a gun in hand. Flashes indicate the moment when some shots were fired by the suspect.

On April 25, the Civil Police heard a new statement from the retiree’s wife, Marília Pepino. The wife reported that Luis began to offend Manoel while they were walking the dog and after the argument, Manoel went home to get a gun.

Lawyer arrested for death of retiree after dog fight is released

According to the victim’s wife, Marília Pepino, Manoel was sitting with her and the family dog, who goes by the name Lobo, in a square. The animal was without a collar or muzzle, as it was considered docile by its owners.

The lawyer was walking his dog at the scene. An argument began when the dogs smelled each other, and the lawyer said that he had already warned the retiree about his animal being loose.

“Here at home, we didn’t see this need [de estar na coleira]. We went out at night to sit in the square with the dog, Wolf. As he is a docile dog, we sat there with him and this man came with his dog on a leash”, said Marilia.

According to Marília, the argument got heated, with a lot of swearing and threats, and her husband went home to get a gun. When he returned, the exchange of gunfire took place.

According to the Military Police, the lawyer said that he and the elderly man had already had a disagreement over the dogs. The same information was given by friends and relatives of the retiree.

Luis told the Military Police that the retiree had started shooting. Manoel’s wife stated that it was the lawyer who shot first. When questioned, the Military Police and Civil Police have not yet provided this information.
