Espírito Santo employees may be punished with dismissal if they practice moral and sexual harassment in the public administration environment. The rule applies to civil servants in direct administration, local authorities, public foundations and those with a military career.

Complementary Law No. 1,080 was sanctioned by the State Governor, Renato Casagrande, last Friday (3), and replicates a concern present in Integrity Programs, including in the private sector.

According to the State government, the text changes sections of the Legal Regime for Civil and Military Public Servants of Espírito Santo (Complementary Law No. 46/1994) and the Code of Ethics and Discipline of State Military Personnel (Complementary Law No. 962/2020) , including moral harassment and sexual harassment in the list of conduct prohibited for civil and military employees of the State.

“Today we celebrate an important step in guaranteeing rights and promoting a fair and respectful work environment for all public servants. It is an achievement that reflects the joint effort and demonstrates our commitment to cultivating a culture of respect and transparency in our institution. We count on everyone’s collaboration to ensure compliance with this law and to promote a truly inclusive and respectful work environment”, stated the governor.

For the Secretary of State for Control and Transparency, Edmar Camata, with the legal provision of these specifications and a specific reporting channel for cases, through the State Ombudsman’s Office, linked to the Secretariat for Control and Transparency (Secont), the government of The State aligns itself with best practices against these behaviors that are harmful to the work environment.

“With the sanction of the Law, we demonstrate our commitment to ethics, integrity and dignity in public service. We will not tolerate sexual and moral harassment in the workplace and updating the legislation will provide us with the necessary tools to actually punish this conduct ”, stressed the secretary.

He guaranteed that all employees will be aware of their rights and responsibilities, so that they feel supported to report any form of harassment, even silent cases.

Reporting channels

Complaints may be made identified, confidential or anonymous, on the Ombudsman’s website. An exclusive channel will also be available, with its own service for reporting harassment, via telephone 0800 022 11 17, accessible via option number 3.

Cases of moral and sexual harassment will be investigated by the State General Inspectorate, with the Secretariat of Management and Human Resources (Seger) responsible for welcoming, when necessary, possible victims of harassment, which will be done by the Health and Quality of Life Management at the Work, in addition to planning preventive actions to avoid new cases.

Camata points out that, with the measure, “we are building a culture of respect and transparency in our institution, which is also aligned with the Global Compact and the UN Sustainable Development Goals”, said Camata.

Combating moral and sexual harassment in the workplace is also directly linked to the Sustainable Development Goals (SDGs), especially SDG 5 (Gender Equality) and SDG 8 (Decent Work and Economic Growth).

Combating harassment at work is fundamental to promoting the health and well-being of workers, in addition to promoting a safe and respectful work environment, it contributes to gender equality, as well as the creation of decent jobs and sustainable economic growth.
