Commissioned and temporary employees of the state departments of Planning (Seplan) and Administration (Sead) can now request managers to work remotely (home office). This Wednesday (1st), the government published guidelines for teleworking for workers in both departments.

The measures for the experimental establishment of the regime were published in the Official State Gazette (DOE). According to the publication, the decree has the ‘objective of promoting a results-oriented culture, with a focus on increasing the efficiency and effectiveness of public services provided to society’.

The server must adhere to the teleworking regime through a protocol in the Electronic Information System (SEI) directed to the person responsible for their sector. The boss will readjust the service and approve whether or not the employee works from home.

After adjusting and defining the execution of tasks, the person responsible for the sector must inform the secretary of the department of the change. The number of employees working from home must not exceed the limit of 50% of the workforce.

If it exceeds, it will be up to the manager to establish a rotation schedule. “The provisions of this decree apply to civil servants occupying commission positions and to temporary civil servants, in accordance with specific regulations”, highlights the decree.

Article 2 of the decree establishes that ‘authorization to work from home does not imply a change in assignment and exercise, nor does it generate an acquired right to remain in this type of work. Furthermore, the time spent teleworking is considered as effective exercise for all legal purposes’.

Also according to the publication, duties that cannot be carried out outside the secretariats and those in which it is not possible to evaluate the employee’s performance are incompatible with the home office.

Teleworking is not compatible with payment of:

  • additional for extraordinary service;
  • nighttime supplement;
  • additional working hours or additional hours;
  • any other advantage based on the extension of the working day

Seplan and Sead must issue specific regulations on the decree to ensure the full functioning of activities.
