The State Audit Court (TCE/RN) formed, this Monday (29), the triple list of Substitute Counselors to fill a vacancy in the Court, opened after the retirement of counselor Maria Adélia Sales. The triple list was composed based on the criteria of merit and will be forwarded to governor Fátima Bezerra (PT).
The process for forming the triple list was reported by the president of TCE/RN, counselor Gilberto Jales. The rapporteur’s vote established the order of candidates based on the criteria listed in Resolution No. 004/2024. They are: performance, productivity, promptness and technical improvement.
Approved unanimously by the councilors of the Court of Auditors, the vote indicated the following order for the formation of the list: in 1st place, substitute councilor Antônio Ed de Souza Santana; in 2nd place, substitute counselor Ana Paula de Oliveira Gomes; and, in 3rd place, substitute advisor Marco Antônio Montenegro.
According to the understanding of the Federal Supreme Court (STF), the indication of vacancies for positions of Councilors of Audit Courts follows the “captive chair” criterion, that is, the new appointment must be made by the same authority and respecting the same criteria used previously.
Considering that the vacancy in question was filled by appointment by the head of the Executive Branch, linked to the career of Substitute Councilor, it is up to the State Governor to nominate the new member, also linked to this career.
The president of the TCE will forward the triple list, in descending order of scores, accompanied by a full copy of the internal application files, including the CV of each candidate, and the minutes of the extraordinary session, to the State governor. The governor is responsible for choosing the next counselor of the Court of Auditors. The order present in the triple list does not bind the choice of the Chief Executive.
The State Constitution stipulates that three of the seven vacancies for Councilor of the Court of Auditors are chosen by the State Governor, with approval by the Legislative Assembly, from among Substitute Councilors and Members of the Public Accounts Ministry.
Furthermore, the formation of the triple list of nominations for the position of Counselor must alternate between the criteria of seniority and merit. In the specific case, as the last triple list was formed based on the seniority criterion, the new list must follow the merit criterion.
