Minister Alexandre de Moraes, of the Federal Supreme Court (STF), sentenced Andre Luiz Vilela and Jairo de Oliveira Costa to 12 years in prison for undemocratic acts carried out in Brasília, on January 8, 2023. They will still have to pay, jointly with the other convicts, compensation in the amount of R$30 million.

The sentences were handed down on April 25th. The minister condemned them for the crimes of: violent abolition of the Democratic Rule of Law, Coup d’état and armed criminal association. Both André and Jairo were acquitted of the crimes of qualified damage and deterioration of listed property.

These were the mildest sentences ever handed down by the minister to defendants from Mato Grosso. Rosely Pereira Monteiro, for example, was sentenced, in November 2023, to 17 years in prison. In February, Simone Aparecida Tosato Dias was sentenced to 13 years and 6 months and, in March, Maria do Carmo da Silva was sentenced to 14.

Non-criminal prosecution agreements

Not all of the January 8th defendants are being condemned by the minister. Moraes validated, in April, another 48 agreements signed between the Attorney General’s Office (PGR) and people facing criminal actions for undemocratic acts. In total, 172 defendants for crimes considered to be less serious benefited.

Agreements were only signed with people who were in front of the barracks and against whom there is no evidence of participation in the invasions of public buildings. In addition to confessing to the crimes, the defendants committed to providing services to the community or public entities, not committing similar crimes or being prosecuted for other crimes or misdemeanors, in addition to paying a fine.

They are also prohibited from participating in open social networks until full compliance with the conditions established in the agreement. In addition, they will have to participate in a course on Democracy, Rule of Law and Coup d’Etat. With the validation of the terms, the precautionary measures previously imposed by Minister Alexandre de Moraes were revoked.
