More than 40 environmental infraction notices were issued during an inspection carried out by a task force on irregular constructions built within the Permanent Preservation Area (APP) of the Araguaia River. The operation was coordinated by the São Félix do Araguaia Public Prosecutor’s Office (1,200km from Cuiabá), aiming to map and prosecute irregular buildings.

The task force, made up of the Public Ministry of the State of Mato Grosso (MPMT), Federal Public Ministry (MPF), Civil Judiciary Police (PJC-MT) and the State Secretariat for the Environment (SEMA), carried out inspections between April 24th and 27th, 2024.

With administrative procedures underway, both at the MPMT and at the MPF, the existence of several constructions in unconsolidated areas on the banks of the Araguaia River, within the permanent preservation strip, was found. The infractions identified by satellite images were confirmed on site, which is why the teams drew up more than forty environmental infraction notices.

“The administrative notice issued by SEMA against the offenders will be accompanied by a summons, which will indicate the date and time of the hearing, to be held at the Public Prosecutor’s Office. The purpose is to formalize a Conduct Adjustment Term (TAC), which will cover environmental damage, as well as the conclusion of agreements in the criminal field, in appropriate cases. This is an innovative interinstitutional approach that aims to resolve, extrajudicially, in a quick, effective and unified manner all the illicit acts found”, said prosecutor Marco Antonio Prado Nogueira Perroni.

In addition to identifying and notifying irregularities, the task force sought to begin mapping alternatives for the environmental regularization of the urban area of ​​São Félix do Araguaia. Therefore, on that occasion, the MPF and MPMT prepared a joint recommendation for the Municipality to carry out studies to identify and delimit the occupied areas on the banks of the Araguaia, as well as present a preventive project to avoid new occupations in the area and prepare an urban land regularization project. “The completion of the land regularization process will provide significant socio-environmental gains, as it will bring legal security to owners and entrepreneurs who own or occupy properties subject to regularization”, added Public Prosecutor Guilherme Tavares, member of the Working Group of the 4th Coordination and Review Chamber (GT – Araguaia-Tocantins), author of conservation actions in this river basin.
