The Federal Regional Court of the 4th Region (TRF4) postponed the judgment of an appeal by the Federal Public Ministry (MPF) against the decision that authorized the progress of the project for the construction of the bridge in Guaratuba, Coast of Paraná. There is still no information about the new date for the appeal’s judgment.

The TRF4 will define whether the monocratic decision of judge Fernando Quadros da Silva, who in October last year determined the resumption of the Guaratuba Bridge execution contract, overturning an injunction from the 11th Federal Court of Curitiba that suspended the prior environmental license for bridge construction.

The injunction that suspended the work had been requested by the MPF, under the argument that the Environmental Impact Study and the Environmental Impact Report (EIA/Rima) presented by the state of Paraná, responsible for the project, did not identify or measure the environmental impacts of the bridge installation. Among these impacts would be the effects of the bridge’s nighttime lighting on the marine fauna and birds of Guaratuba Bay.

Judge Fernando Quadros da Silva mentioned that the suspension would bring, stated that the suspension of the license had caused “risks of serious damage to assets legally protected by legislation”, in addition to pointing out the benefits that will be brought by the bridge to the municipalities of Guaratuba and Matinhos, “today precariously served by the water transport service”.

The MPF appealed the decision that allowed the Guaratuba Bridge project to proceed, asking the judge to reconsider or for his monocratic decision to be analyzed by the Special Court of the TRF4. According to the regional prosecutor of the Republic José Osmar Pumes, who signed the appeal, the prior environmental licensing process requires authorization from ICMBio and not just the Water and Land Institute (IAT), as was done.
