Brasília – The president of the Chamber of Deputies, Arthur Lira (PP-AL), stated that the country has a cancer called Direct Action of Unconstitutionality (ADI) due to the number of proposals of this type presented to the Federal Supreme Court (STF), which ends up reversing decisions of the Legislature in certain cases. The statements were made at the opening ceremony of the 89th edition of ExpoZebu, after he commented on the analysis of the Temporal Framework for indigenous lands.

“In Brazil, legal discussions never end, because the STF receives demands every day, from all sectors. We have a cancer in Brazil called ADI, proposed by any entity, any person or any political party with a representative in Congress. What’s the point of a project with 400 votes in the Chamber plenary and a parliamentarian comes in with an ADI, and a minister issues an injunction?”, said the deputy.

Lira stated that parliamentarians need to have the courage to face this issue and “raise the bar” on who can propose this type of action in the country “so that fewer issues are judicialized and more issues are discussed politically by those who have the people’s power of attorney to discuss these themes”.

This week, the government proposed an ADI questioning the extension of the private sector payroll tax exemption and the change in the social security contribution rate for municipalities. Minister Cristiano Zanin, rapporteur of the case, granted an injunction and was already accompanied by four votes in the virtual plenary. The analysis was halted after a request for a review from Minister Luiz Fux.

Lira even joked about wanting to spend more time in Uberaba, where the fair takes place, to clear her head and return to Brasília energized. “Brasília is where everything is discussed and decided. When it doesn’t get in the way, it helps a lot,” she said.
