Assembly has one year to reduce salaries of 1991 appointees

The Legislative Assembly of Alagoas has one year to correct the salaries of almost 1,200 civil servants that it illegally appointed 33 years ago and in defiance of what is established in the Federal Constitution of 1988 and the state Constitution of 1989. All of them were appointed Legislative employees to positions also created contrary to the law and at a time when the requirement for a public examination was an imposition that was not respected by the Board of Directors at the time.

The decision is from the Court of Justice of Alagoas (TJAL), which took three years to complete the trial of an unconstitutionality action involving two acts of the Assembly – both from 1991 – and confirm a first degree sentence from 17 years ago in a popular action filed in 1997 by a group of 45 independent professionals including lawyers and engineers linked to the Regional Engineering Council (Crea-AL), Institute of Architects of Brazil, Union of Engineers of Alagoas and Engineering Club of Alagoas and led by the Order of Advogados do Brasil de Alagoas (OAB-AL), at the time chaired by lawyer Marcelo Teixeira.

In the popular action that was initially processed in the 15th Civil Court of the Capital/State Treasury (0014645-07.1997.8.02.0001), the entities questioned Resolution No. 346 of January 30, 1991 by which the number of permanent positions in the Legislature was simply changed from 1,693 – according to publication in the Official Gazette of December 5, 1989 of Bureau Act 122/89 – to 3,099 through the addition of 1,406 new positions.
