Banks auction debtors’ properties in Espírito Santo for prices starting at R$71,000 and also make others available for direct sale, in partnership with construction companies.

In total, there are 15 properties in the State offered in auction by Caixa Econômica Federal and the State Development Bank (Bandes). The Caixa auction will take place on the 2nd, being completely online, via the website globoleiloes.com.br starting at 10 am, but bids can now be made.

The competition involves 226 properties across the country, two of which are in the State: a 45.82 square meter (m) apartment in Jardim Limoeiro, in Serra, and a 62.25 m apartment in Coqueiral de Itaparica, Vila Velha.

The Bandes auction involves 13 lots in the State and another two in Rio de Janeiro. The event is in person and will take place on the 30th at 2pm, at the Bandes headquarters, in the center of Vitória. Apartments, buildings, industrial warehouses and rural units will be put up for sale.

Josmar de Souza Pagotto, master and doctorate student in Law at FDV, explained that the properties that are auctioned by banks are, for the most part, assets that were repossessed by the institution after defaulting on real estate financing contracts:

“But properties can also go to auction for other reasons, such as a way to pay a debt, default in paying IPTU, condominium fees, when the asset is placed as collateral for an unpaid debt, among others.”

The president of the Real Estate Law Commission of the Brazilian Bar Association – Espírito Santo Section (OAB-ES), Fabiano Harada, explains that, in general, it is worth buying properties at auction as it is cheaper.

“It is possible to buy it for up to half the original price, but it is important to check if it is unoccupied or if it has debts”, he explains.

In addition to auctions, banks such as Caixa Econômica and Banco do Brasil also make properties available through direct purchase. Caixa, for example, has seven properties in this type of offer in the State.

“The main difference lies in the type of offer. At auction, there is a price dispute through bids. In direct sales, banking institutions can set the market price and carry out the operation”, explained lawyer specializing in Real Estate Law Carlos Augusto da Motta Leal.

Buyer can call police to remove resident

One of the concerns regarding the purchase of a property repossessed by banks due to debt is the possible headache for potential residents. The situation may even involve police forces, according to experts.

“In some cases, the bank itself promotes reoccupation. But it may also be the case that the contract states that this will be the buyer’s responsibility. The ideal is to communicate the sale, notify, give a deadline and, if it is not resolved, file a police report to register and file an eviction action”, explains lawyer Raphael de Barros Coelho.

According to the president of the National Federation of Real Estate Brokers (Fenaci), Eriveltón Moreira, it is common for families to refuse to vacate and the buyer to have to get involved in a legal battle. “It is common for the price of the property to be lower, due to the risks”.

The president of the Real Estate Law Commission of the Brazilian Bar Association – Espírito Santo Section (OAB-ES), Fabiano Harada, details that, as a last resort, even the police force can be involved: “With monitoring by the court official. ”

– Auction

The highest bid offered until the close of the edition was R$71,949.80. The property is valued at R$119 thousand.

A 62.25m2 apartment with two bedrooms and one bathroom in Coqueiral de Itaparica, Vila Velha, located at Avenida Adelio Silva Britto, nº 650, apartment 102, block 402, module C, in Coqueiral de Itaparica, Vila Velha. Minimum Bid: R$130 thousand. There had still been no offers received at the time of publication. The property is valued at R$200,000.

Caixa also makes seven properties available in Espírito Santo for direct sale online via the website https://acess.one/imovelcaixa.

Some examples are:

House measuring 150 m with four bedrooms, two balconies/balconies, laundry area, two bathrooms, two living rooms, toilet and kitchen, located on Rua Sandro Boticelli, nº 43, Parque Residencial Laranjeiras, Serra. Valued at R$777,649, and with a minimum sales value of R$573,749.43.

Another example is an unoccupied plot of land on Rua Nova, without number, in Baunilha, Colatina. The lot has an area of ​​10,746.59 m and a perimeter of 418.23 meters. Minimum bid: R$419,840.

– Buy at auction or direct sale?

According to experts in the field of Real Estate Law, it is better to buy at auctions, considering the advantage gained by paying a price below the market price.

However, in this case, conflicts of interest may be prosecuted, causing delay in obtaining possession or property, and the process may lead to a judgment of invalidity, ineffectiveness or nullity of the auction.

Direct sales, made by construction companies in partnership with financial agents, without any charges or conflicts, have a higher cost, however, they provide more stability and guarantee the validity of the legal transaction concluded.

– What precautions should I take when buying at auction?

Buying and selling at auction has legal protection against other liabilities of the debtor, as mortgages, pledges and unavailability, of any nature, are extinguished by auction or adjudication.

However, the buyer must:

Be aware of the auction notice and its conditions; whether payment must be made in cash or in installments;

Know and visit the property offered and be aware of its condition and whether the purchase and sale will be advantageous, after carrying out works and renovations; obtain a certificate of encumbrance for the property, and find out if there are pending processes and appeals that could cancel the sale;

Find out if there are co-owners, if there are condominium and IPTU liabilities that affect the property itself, and if there are sharing disputes, adverse possession or other situations that affect property rights.
