The governors of the states in the South and Southeast regions presented this Tuesday, 26th, four proposals to toughen up the fight against crime in Brazil, including the review of the requirements for granting provisional release in custody hearings, responsible for “catch and release”.

The draft bills were delivered by governors Eduardo Leite, from Rio Grande do Sul, Cláudio Castro, from Rio de Janeiro, and Ratinho Jr., from Paraná, to the presidents of the Senate, Rodrigo Pacheco, and of the Chamber, Arthur Lira, and the Minister of Justice and Public Security, Ricardo Lewandowski.

The first of them proposes a review of the legislative requirements for granting provisional release in custody hearings in the case of serious crimes and when there is a repeat offense.

“It is important to note the notorious difficulty in the typical performance of state security forces, given the scarcity of material and human resources, exacerbated by the procedures combined with the effectiveness of the custody hearing, given the transportation of those in custody to the places where the hearings take place, its transportation to prison establishments and, also, its reworking with successive arrests of the same individual”says the proposal.

“Additionally, to the issues mentioned, the insecurity of action by public security agents in the face of constant claims of responsibility in the face of the word of the person in custody regarding supposed illegal incidents that occurred during the arrest”he adds.

Approaches, electronic monitoring and criminal organizations

The second proposal updates the legislation on the requirements for approaches, reinforcing the prerogative to carry out approaches according to suspicious circumstances and making it clear in the legislation that acting based on prejudice is prohibited.

The third proposal allows police forces access to electronic monitoring information independent of judicial authorization, with the aim of improving integration and qualifying police action and investigations.

And the fourth makes the crime of homicide qualified when it is committed by or at the behest of a criminal organization.

“I am sure that the National Congress and the Ministry of Justice, which received the proposals today, will be sensitive to what the Cosud governors presented. These are proposals with the potential to greatly help in combating crime and improving security for everyone”stated the governor of Rio Grande do Sul, Eduardo Leite.
