The Legislative Assembly of Sergipe (Alese) unanimously approved, during the plenary session this Tuesday, 26th, Bill (PL) No. 77/2023, which authorizes Banese to plan, organize and operate the public lottery service, on behalf of the State Executive Branch.

Authored by the State Government, the Bill aims to finance actions aimed at culture, the environment, inclusion and social assistance, as well as reducing the socioeconomic vulnerability of Sergipe residents.

Furthermore, the measure is yet another action by the governor of Sergipe, Fábio Mitidieri, to strengthen the Sergipe people’s bank, making it even more solid, sustainable and close to the population.

In October 2021, Law No. 8,902 allowed the State Executive Branch to provide, directly or under concession or permission, the public lottery service in the state. The new text approved by Alese authorizes Banese to operate the service, in addition to providing other measures.

To implement the lottery, the PL determines that the bank may choose to create a subsidiary, a holding company, or participate in a corporate structure to explore such services. The supervision of these new services will be the responsibility of the Public Services Regulatory Agency of the State of Sergipe (Agrese).

Recommendation

Author of the recommendation that proposes to the State Government the regulation of the public lottery service in Sergipe, the licensed state deputy and current Secretary of State-Chief of the Civil House, Jorginho Araujo, explains that Law No. 8,902, of October 6, 2021 , already established the state’s right to adopt initiatives to enable its respective provision of lottery services using its own criteria, possibly different from that adopted at the federal level of lottery operations.

“In September 2020, the STF ruled that the Union’s exclusive exercise of lottery activities was unconstitutional. The former monopoly can now be exercised simultaneously by the States, with it being up to them to manage their own lotteries, applying the same rules already used by the Union”, emphasizes Jorginho Araujo.

Still according to him, currently, lottery revenue is around 0.2% of GDP, compared to a global average of 1%. “With this growth potential, also considering the state GDP, the Government of Sergipe alone will be able to raise around R$480 million per year. This, surprisingly, without having to impose any new taxes either on the population or on any other economic activity”, adds Jorginho.

Consignable margin

Alese also approved Complementary Bill No. 09/2024, which increases the maximum percentage of consignment of active and inactive public servants in the State of Sergipe to 45%, and creates the possibility of using up to 5% of the consignable margin through assigned credit card.

The measure equates the ceiling on the consignment margin for state public servants to that of federal public servants, and allows them to have access to the consigned benefit card for purchases at commercial establishments or withdrawals.
