Several categories of independent professionals are included in the tax reform regulation project, delivered by the government’s economic team to the National Congress, on Wednesday (24).

Among the 18 segments benefiting from a lower tax burden are professionals such as lawyers, engineers, biologists, economists, architects and personal trainers. The benefit applies both to those who provide services as an individual and to those who issue notes as a legal entity – in the second case, under some specific conditions.

According to the proposal presented by the federal government, there will be a 30% reduction in the rates of Tax on Goods and Services (IBS) and Social Contribution on Goods and Services (CBS).

The CBS and IBS make up the Dual Value Added Tax (VAT), considered the crucial point of the consumption tax reform, which will be managed, respectively, by the Union and by states, the Federal District and municipalities. These two new taxes will replace the current IPI, PIS and Cofins (federal), ICMS (state) and ISS (municipal).

Considering an average rate of 26.5%, projected by the government with the tax reform, the new taxation for these 18 professional categories would be 18.6%. Professions related to services covered by the 60% reduction in tax rates are excluded from this list – such as doctors and nurses.

Professionals who provide services as a legal entity are subject to a series of requirements that must be met, including supervision by a professional council and not having another legal entity as a partner, nor being a partner in another company.

“The reduction in rates applies to individuals or legal entities that meet certain requirements, defined with the purpose of ensuring a direct link between the services provided and the professional qualifications of the providers of these services”, states the government in the justification text of the project.
