The Rio Court accepted the complaint against Érika Souza, the woman who took her dead uncle to a bank branch to try to get a loan. She became a defendant for vilification of a corpse and attempted theft by fraud. However, the Court also accepted Érika’s defense request that she be released and ordered the release permit to be issued.

The decision was made by judge Luciana Mocco, from the 2nd Criminal Court of the Bangu Region. The judge agreed with the arguments presented by the defense, that maintaining the prison would be an extreme measure, since Érika is a primary defendant, has a fixed residence and has poor mental health. For the judge, Erika also does not present any danger that could harm the investigations or public order.

Despite agreeing that the case has a great public outcry, the judge points out that this in itself is not enough. In this way, she orders Érika’s release, but establishes some precautionary measures, namely:

  • Monthly attendance at the court registry, to inform and justify your activities or possible change of address. In this case, the new address must be informed before moving, under penalty of new arrest;
  • Considering the proof of a medical report indicating the need for hospitalization for mental health treatment, if this occurs, the court must also be communicated;
  • Prohibition of being absent from the District for a period exceeding seven days, except with express authorization from the court.

The Public Ministry of Rio denounced her this Wednesday (1st) for both crimes. The MP is still analyzing the charge of culpable homicide, when there is no intention to kill, included in the investigation by the Civil Police on Tuesday (30).

In the complaint, prosecutor Débora Martins Moreira highlighted that Érika demonstrated “contempt and disrespect” for the elderly man, knowingly, by taking him dead to withdraw the money. The body also expressed its opposition to Érika’s defense request for provisional freedom, but which was granted by the Rio Court.

At the conclusion of the report, the delegate investigating the case says he is sure that Érika knew that Paulo Roberto Braga was already dead. According to Fabio Souza, there was a “glaring failure to provide help”, because, even though she knew that her uncle’s life was at risk, she decided to go to the shopping mall and then to the bank.

Érika Souza was imprisoned in the Gericinó Complex, in Bangu, in the West Zone of Rio.
