Court orders niece released and makes her a defendant for 2 crimes

Erika’s defense took a stance on the court’s decision. “A release permit was issued with the revocation of the preventive release. We want to thank all those who supported, who believed, who fought and who are with us,” lawyer Ana Carla de Souza told UOL.

Erika is the niece of Paulo Roberto Braga, who was pronounced dead at a bank branch in Rio de Janeiro. The incident happened on April 16th.

Érika was charged with the crimes of attempted embezzlement and vilification of a corpse. Prosecutors state that, although the loan was taken out by Braga when he was still alive, the withdrawal of R$ 17,900 could no longer be carried out, since, at the time of the accused’s arrest in the act, the victim had already died .

MPRJ expressed its opposition to a request for provisional release from the defense. “The accused, consciously and voluntarily, vilified the body of Paulo Roberto Braga, her uncle and for whom she was the caregiver, by taking him to the aforementioned bank branch and remaining there, even after his death, for the purpose of looting the payment order mentioned above, thus demonstrating total contempt and disrespect towards him”, says an excerpt from the complaint.

Prosecutors highlight the health condition of the elderly person in the previous days. The complaint highlighted that Paulo would have been discharged the day before the events, after hospitalization caused by pneumonia, “it is certain that he was quite weak, which is easily verified, notably, given the testimony given by the doctor at the Emergency Care Unit”. It also points out that the autopsy report confirms that the victim presented a “cachectic state” during the examination.
