Federal Supreme Court (STF) minister Cristiano Zanin responded to a government request and suspended this Thursday (25) sections of the law that extended the payroll tax exemption for companies and municipalities until 2027.

The request from the Attorney General’s Office was sent to the STF on Wednesday (24).

Planalto and AGU entered the STF questioning the constitutionality of the law that extended the payroll tax exemption for companies and municipalities until 2027

The minister agreed with the government’s argument that the resignation cannot be given without indicating the budgetary impact. According to Zanin, without this forecast there is a risk of a significant imbalance in public accounts and even the emptying of the tax regime.

Zanin established that the suspension will be valid until the fiscal impact of the measure is indicated. The minister’s decision will be judged in the STF’s virtual plenary session starting at midnight this Friday. Ministers can enter their votes in the electronic system until May 6th.

The tax relief law was enacted by Congress last year and allows 17 labor-intensive sectors to replace the 20% social security rate on salaries with a rate of 1% to 4.5% percent on gross revenue.
