BRASILIA – The president of the Chamber, Arthur Lira (PP-AL), said this Wednesday, 24, that the Proposed Amendment to the Constitution (PEC) that grants a salary bonus to judges and members of other public service careers, known as a Quinquennium PEC, it is unlikely to be approved in the House. The matter is discussed in the Senate with the blessing of the President of the House, Rodrigo Pacheco (PSD-MG).

Lira said that some projects being processed in the Senate increase public expenses. “An issue like the Quinquennium PEC is unlikely to progress in the Chamber,” he said. The Ministry of Finance estimates that the cost of the project could reach R$40 billion per year, according to the government leader in the Senate, Jaques Wagner (PT-BA).

Lira made the statements in a debate on the economic agenda organized by the Confederation of Brazilian Business and Commercial Associations (CACB), in Brasília.

The text of the PEC provides for the return of the so-called five-year period, a bonus in the remuneration of judges and prosecutors paid every five years of service – which was abolished in 2003. The senator Eduardo Gomes (PL-TO), rapporteur of the proposal in the Senate, extended the benefit to other categories, including members of the Attorney General’s Office (AGU), the Public Defender’s Office and delegates from the Federal Police.

If the benefit is approved, a judge who earns more than R$40,000 per month may have a 5% increase every five years until the end of his career, in addition to other benefits he already receives, such as housing. The amount will be paid without being calculated within the limit of the salary cap that a public employee can receive per month. Today, this amount is the equivalent of the remuneration of a minister of the Federal Supreme Court (STF): R$44,008.52 per month.

On Tuesday, the 23rd, the president of the Senate, Rodrigo Pacheco, defended the approval of the PEC and claimed that it does not harm the fiscal balance. He admitted that he can negotiate with the Executive to reduce the list of categories entitled to the five-year period.
